Mandatory professional cleaning fees
Tenant Fees Act 2019
Only enforceable if the landlord has a dated receipt proving the property was professionally cleaned at the start of the tenancy. Without evidence, this fee is a prohibited payment.
Excessive late rent interest
Tenant Fees Act 2019
Interest on overdue rent is capped at 3% above the Bank of England base rate. Any clause specifying a higher rate is void even if signed.
Repair liability waiver
Landlord and Tenant Act 1985, s.11
Landlords cannot contract out of their obligation to maintain the structure, exterior, and installations. Any clause transferring these obligations to the tenant is unenforceable.
Waiver of quiet enjoyment
